When to begin with the Renewal of Trademark Online Process

    1. According to Rule 57 and Rule 58 of the Trade Mark Rules, 2017; a trademark can be filed for renewal within 12 months post its expiry
    2. As per Rule 63 and Rule 64 of the Trade Mark Rules, 2002; a renewal can be filed for within six months before its expiry.
    3. The trademark renewal can be filed within 180 days time post the expiry of the trademark protection; however it is attached with an additional fee.

    1. Notice: The Trademark Registry sends a notice to the proprietor of the trademark, it is usually sent six months before the expiry date of the trademark. In order to keep the trademark in the Register, it needs to be renewed or restored within the given time.
    2. Application: The Applicant/ Legal Representative of the Applicant files TM-R for trade mark registration renewal.
    3. Examination: The application is carefully examined at the Registry.
    4. Publishing: If the application is crosschecked and is passed by the Examiner, the trademark will be published in the Trademark Journal.
    5. Form: TM-18 needs to be filed along with the prescribed fee, post which the application can be approved for renewal.

    1. The renewal of a trademark online must be filed within 12 months prior to the date of expiry according to rules 57 and 58 in Trade Mark rules 2017.
    2. The renewal must be filed within six months before the expiry date according to rules 63 and 64 in Trade Mark rules 2002.
    3. The renewal can also be filed within six months after the date of expiry.
    4. In case there is negligence in renewing, after the date of expiry it will result in the removal of the mark from the Register of Trademarks.
