Factors to be kept in mind while forming a society under Society Annual Compliance

  • Any seven or more than seven persons associated with any Literary, Scientific, or Charitable purpose, may, by mentioning their names to a Memorandum of Association and filing the same with the Registrar of Societies create Society under the Societies Registration Act 1860.
  • Societies that propose to work on all India bases must have one member each from at least seven states of the Union of India.
  • As per the Emblems Act, 1950, the use of any name, emblems, official seal, etc. is strictly prohibited without the previous permission of the competent authority. The Societies planning to register are suggested to consult this Act also before proposing the name, etc. for registration.
  • In case the proposed name is the same as that by which any other society has already been registered or resembles, or is likely to deceive the public or the member of society, must be avoided.
  • The Memorandum of Association must contain details related to the name of the society, the purpose of the society, and the names, addresses, and occupations of the governors, council, directors, and committee, among other important details.
  • A certified copy of the rules and regulations of the society by at least three of the members of the governing body must be filed with the memorandum of association.
  • All the signatures of the desirous persons/subscribers given in the memorandum needs to be witnessed by an Oath Commissioner, Notary Public (Notarial stamps affixed), Gazetted Officer/Advocate, or Magistrate 1st Class.
